Welcome to MintyStonePath ("we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of our yacht charter services and our website at mintystonepath.sbs (the "Service"), which are provided by MintyStonePath.
By engaging in our charter services or by accessing our Service, you hereby agree to these Terms. If you do not agree with any part of these terms, you should refrain from accessing the Service.
2. Service Overview
MintyStonePath offers a range of luxury yacht charter services, which include, but are not limited to:
- Exclusive yacht rentals for a day
- Evening sailings
- Business getaways
- Special gatherings
- Extended yacht expeditions
Service availability is subject to current conditions and offerings may be modified or halted without prior notice.
3. Booking and Reservations
3.1 Booking Process
When securing a charter, you must:
- Be at least 18 years old
- Offer precise and complete details
- Make the required upfront payment as noted on your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your reservation is deemed firm only when payment has been made and you receive our written confirmation. We hold the discretion to decline service to any individual.
3.3 Availability
Charter services are reliant upon the availability of vessels and favorable weather. We aim to fulfill your preferred schedule as much as possible.
4. Payment Terms
4.1 Pricing
All pricing is provided in € and includes any relevant taxes, unless indicated otherwise. Prices may fluctuate and are subject to change without any prior notification.
4.2 Payment Schedule
- Initial deposit: 50% of the complete charter fee, due upon reservation
- Final amount: To be paid 48 hours ahead of the charter’s departure
- Additional fees (if applicable): To be settled upon conclusion of the charter
4.3 Payment Methods
We accept a variety of payment methods including widely-used credit cards, bank wire transfers, and certified checks. Payments are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Full refund less transaction fees
- If canceled 24-72 hours before the departure: A refund of 50% is provided
- If canceled less than 24 hours before departure: No refund is provided
5.2 Weather Cancellations
In situations where weather conditions are considered unsafe by our captain, we will provide the option to:
- Move your charter to an alternative available date at no extra charge
- Issue a full refund when rescheduling is unfeasible
5.3 Mechanical Issues
If a mechanical malfunction occurs with your designated yacht, our goal is to supply an appropriate substitution. Should no alternative be accessible, a complete refund will be given.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all instructions from the crew
- Utilize any safety gear when instructed
- Inform of any health conditions that could impinge on their security
- Stay within assigned areas aboard the vessel
6.2 Prohibited Items
The subsequent items are forbidden on board:
- Containers made of glass
- Unlawful items
- Guns or other weaponry
- Inordinate non-alcoholic beverages
- Animals (unless granted permission in advance)
6.3 Conduct
Patrons are expected to behave courteously. Any charter may be terminated early without any refund if behaviors of individuals pose a safety threat or disrupt the fulfillment of other guests.
7. Liability and Insurance
7.1 Our Liability
We carry liability only up to the amount paid for your charter and are not accountable for:
- Personal harm due to passengers' neglect
- The loss or harm to personal belongings
- Secondary, successive, or punitive losses
- Delays ascribed to weather or situations out of our control
7.2 Insurance Coverage
Our operations are insured comprehensively, covering our watercraft and other aspects of our business. Travel and personal insurance for passengers remain their own responsibility.
7.3 Assumption of Risk
By joining in our charter services, you recognize that marine activities come with intrinsic risks and you are willing to take responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
We hold the rights to adjust itineraries, pathways, or timelines due to weather, safety, or operations needs. All endeavours will be made to deliver comparable experiences.
9. Force Majeure
Delays, cancellations, or alterations brought on by factors beyond our control are not within our realm of responsibility, these include but are not limited to:
- Extreme weather
- Acts of nature
- State regulations
- Harbor shutdowns
- Mechanical disruptions
10. Privacy and Data Protection
Your private data is managed in line with our Privacy Policy. Your use of our service implies your consent to the gathering and usage of your data as detailed in the Privacy Policy.
11. Intellectual Property
All content on our website, such as text, designs, logos, and images, is safeguarded by copyright and other intellectual property statutes. Any reproduction, dissemination, or derivative works require our express authorization.
12. Governing Law
The laws of Germany rule these Terms, with any related disputes being adjudicated by the courts in Hamburg, Germany.
13. Changes to Terms
We retain the capacity to alter these Terms when necessary. Amendments will be communicated via our website with a revised effective date. Continued use after changes signifies acceptance of the new terms.
